The following are the terms and conditions for use of the Carrolls Irish Gifts website or any Internet site to which the Website is linked (the "Website"). This Website is for use by people who are 18 years and over only.

WEBSITE: USE AND SECURITY
You are entirely responsible for any and all activities that occur under your Account which is provided to you by Carrolls Irish Gifts. You agree to notify us immediately of any unauthorised use or any other breach of security.
Carrolls Irish Gifts use Realex Payments or Paypal to provide a secure, robust and reliable payment processing service. Information security is their top business priority. To this end they have invested in extensive security controls and infrastructure.
Realex Payments are certified and approved by several leading financial institutions. Their systems and security controls are based on current industry standards. There are several layers of technology in place to ensure the confidentiality, authentication and integrity of information.
- Realex Payments have been accredited with the AIS (Account Information Security) certification by VISA and is one of the few companies in Europe to achieve this. This shows their commitment to above industry standard in every aspect of payment processing.

- All messages sent to Realex Payments and the responses from Realex Payments are authenticated using digitally signed digests.
- All requests are verified against a legal list of IP address and referring URLs.
- Realex Payments' technical infrastructure is located in secure co-location facilities that have 24x7 manned security and advanced building management systems along with environmental controls.
- Critical servers and applications are monitored constantly to threshold levels and Realex Payments staff is instantly alerted via their real time monitoring and alerting service.
- All connections to the financial institutions are over private dedicated leased circuits, backed up with ISDN lines and in certain cases VPN connections over the internet.
- The network is designed to be highly resilient with duplicate and triplicate systems in place depending on the critical nature of each component.
- Realex Payments are registered with the data protection commissioner as a "Data Processor". Cardholder information is encrypted and not displayed in our reporting systems - realcontrol.
WEBSITE: PRIVACY & DATA USE
We do not hold any personal data. Instead, personal data is stored on a remote secure server and used and is the full responsibility of our hosting provider who host the Website.
WEBSITE/CD ROM: CONDUCT
You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your usage, including the content of your transmissions through the Website. All information, designs, drawings and other specifications provided on the Website are the exclusive property of Carrolls Irish Gifts. Any copying, transmission or re-transmission of the same requires the prior written approval of Carrolls Irish Gifts.
We reserve the right at all times to place advertisements and promotions on the Website. Advertisers and sponsors on the Website or CD ROM are solely responsible for complying with all local, national, state and international laws (where relevant) and we exclude all liability howsoever caused therefrom.
PRICE OF GOODS
The price listed on the Website (the 'Price') for Carrolls Irish Gifts products (the "Products") will be as stipulated at the time when you place your order on the website. We are entitled to make adjustments to the Price to take account of any increase in our supplier’s prices, or the imposition of any new taxes or duties, or if due to an error or omission the Price for the Products on the Website is wrong.
We will endeavour to deliver the Products to you within 3 working days of your Account order within the island of Ireland, where this is practical. However, Products are subject to availability and delays may sometimes occur that are outside of our control. Any dates specified for delivery are therefore approximate only. If delivery is delayed for more than 21 days, you have the right to contact us and refuse to accept the Products. In these circumstances, we will refund any money paid by you for those Products and any delivery monies you have been charged. However, we will not be responsible for any other losses, costs, damages or charges that you may suffer if we delay in supplying or do not supply those Products. At the time of delivery you will be required to validly sign-off on the delivery of the Products, after which time the Products become your sole responsibility.
When you purchase online, you have a statutory right to return a Product (other than perishable produce) up to 7 days after your order has been delivered (cooling off period), this is extended to 14 days if you are located in the European Union. We can change or cancel an order up until it is dispatched. If the order has been dispatched, you can return the Product to us and we will organise a refund (excluding return delivery cost). The product may also be returned for an exchange, but additional shipping charges will apply. If a Product is damaged or faulty please contact us and we will organise a replacement or refund.
Merchandise purchased with us excluding sale items may be returned within 7 days for a full refund (excluding shipping costs) providing merchandise is returned in the same condition as sold, this is extended to 14 days if you are located in the European Union. If merchandise is not returned in the same condition as sold full refunds will not be issued. Partial refunds or no refunds will be offered.

The return policy described below applies to online orders only.
I have changed my mind and wish to return my item for a refund?
You must contact us within 14 days of receiving your order. Please include your order reference number and full name. The item you wish to return must be unused, in the original packaging and in a saleable condition. Refunds may be accepted on all items except perishable goods, earrings and underwear and exclude shipping charges. All items will be inspected on return.
My item is damaged, what can I do?
Please contact us -- include your order reference number and full name. Please also include an image of the item showing the damage. Once verified, we can then work with you on a suitable resolution.
I want to Exchange an Item?
You must contact us within 14 days of receiving your order. Please include your order reference number and full name. The item you wish to exchange must be unused, in the original packaging and in a saleable condition. Exchanges may be accepted on all items except perishable goods, earrings and underwear. All items will be inspected on return.
Once we receive the original item(s) from you, we will reach out to you for payment of the re-shipment and any other additional charges (if applicable) charges and can then ship the replacement(s) immediately.
ACCORDANCE WITH SPECIFICATION
Many of the Products are of a technical nature and it is not practical to publish detailed specifications of all the Products and keep specifications completely up to date. All descriptive matter, drawings, pictures, colours, specifications and advertising on the Website are for the sole purpose of giving an approximate description of the Products.
If any manuals or safety instructions are provided with the Products, you agree to read and follow carefully all the terms contained therein at all times. Any information contained on the Website is not meant to be comprehensive and if you are inexperienced in using the Products or are unsure of your abilities, you should always seek expert advice and assistance.
DISCLAIMER OF WARRANTIES
The information contained in the Website is for information purposes only and, although we have made every effort to ensure the correctness of the information contained herein, the information available through the Website is provided "as is" and "as available" and without warranties or conditions of any kind either express or implied. We do not warrant or represent that the use or the results of the use of the materials available through the Website or from third parties will be correct, accurate timely, reliable or otherwise. We accept no liability in relation to any of the above other than as may be provided for under your statutory rights.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall we be liable to you for any direct, indirect, incidental, special or consequential damages that result from the use of or the inability to use the Website, any changes to the Website, any material or data sent or received or not sent or received or for any of the above-mentioned damages that result from the use or inability to use the Products. In no circumstances shall our liability and that of our suppliers to you and/or any third parties for any of the above exceed €200.

You acknowledge that content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in either sponsor advertisements or email-distributed, commercially produced information presented to you by the Website, by us, or our advertisers or other content providers, is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.
No contract will subsist between you and Carrolls Irish Gifts or any partner store of Carrolls Irish Gifts for a sale to you of any product or service unless and until Carrolls Irish Gifts or the Carrolls Irish Gifts partner store accepts your order by e-mail confirming that it has dispatched your order. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Carrolls Irish Gifts sends the e-mail to you (whether or not you receive that e-mail).
MODIFICATION OF TERMS
We may terminate the Website with or without cause at any time and effective immediately. In addition, we, in our sole discretion, may terminate your Account for violation of the letter or spirit of these terms and conditions.
TAX AND DUTIES
Non EU countries may be subject to tax and duties on goods purchased. The payment of Duties and Taxes are the responsibility of the receiver, Carrolls Irish Gifts take no responsibility for country specific custom taxes, duties, associated with the delivery of your package. For further information please contact your local customs office.
Please note each country has different customs clearance levels. Although most countries accept all imports some items may be refused entry to a specific country. We advise you to check with your local customs office to obtain a list of items that cannot enter the country or that may cause problems.
Please note Ukraine customs do not allow food imports of any kind so if ordering from the Ukraine please do not purchase any food items as they will be returned to Ireland. The customer may be liable for additional charges.
Products containing seeds (wild shamrock and wild Irish flowers) cannot be shipped to Non EU countries. Packages containing these products will be refused at the customs depot and returned to Carrolls Irish Gifts. The customer may be liable for additional charges
